Season Ticket and Match Ticket Conditions of Issue
1. Issue of Season Ticket
1.1 The issue of a Season Ticket and subsequent access to the Ground is subject to
the Terms & Conditions of Entry (which can be found on – or accessed via – the
Club’s website at www.avfc.co.uk or can be provided upon written request to the
1.2 Season Tickets are for the use of supporters of the Club only. By applying for a
Season Ticket and/or using the same you hereby warrant and represent that you
are a supporter of the Club. Season Tickets must be available for inspection by
the Club at any time.
1.3 Season Tickets are non-refundable unless returned and received by the Club prior
to the first Match of the season. All refund requests are to be made in writing.
2. Admission to the Ground
2.1 By purchasing and/or accepting and/or holding a Season Ticket and/or using a
Season Ticket to gain access to the Ground, you: (a) certify that you have read,
understood and accepted; (b) agree to be bound by and to comply with; and (c)
agree to bring to the attention of others, as required below, the Terms &
Conditions of Entry.
2.2 A Season Ticket permits you to occupy at the Match the seat indicated on the
Season Ticket or such other alternative seat as the Club may, from time to time,
allocate to you at its reasonable discretion. For example:-
2.2.1 where the Away Club claims their full ticketing entitlement, North Stand
Upper Season Ticket holders will be required to move to alternative
2.2.2 the Club may, from time to time, choose or be required to close certain
areas of its Stadium. In those circumstances, Season Ticket holders in
the relevant areas will be required to move to alternative seating.
Wherever reasonably possible the Club will move you to a seat of equivalent value
but where this is not possible and the Club moves you to a seat of lesser value the
Club will refund to you the difference between the cost of the seat indicated on
your Season Ticket and the cost of a Season Ticket for the seat to which you have
been moved for the period of time that you are required to move. If the Club
requires you to move and you wish to move to a seat of greater value than your
Season Ticket seat, you will be required to pay the difference between the cost of
the seat indicated on your Season Ticket and the cost of a Season Ticket for the
seat to which you wish to move for the period of time that you are required to
move. All access to the Ground pursuant to a Season Ticket shall be for the
purposes of private enjoyment of the Match only, not for any commercial purpose
(and no authorisation is given or implied in respect of the carrying out of any
2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to
occupy the seat indicated on the Season Ticket in any subsequent season.
2.4 Save as set out in clause 2.5 below, you shall not capture, log, record, transmit,
play, issue, show or otherwise communicate (by digital or other means) any
Material in relation to the Match, any players or other persons present in the
Ground and/or the Ground, nor may you bring into the Ground or use within the
Ground (or provide to, facilitate or otherwise assist another person to use within
the Ground) any equipment or technology which is capable of capturing, logging,
recording, transmitting, playing, issuing, showing or otherwise communicating (by
digital or other means) any such Material. Any person acting in breach of this
provision may have such equipment or technology confiscated and/or will be
required to deliver up any tapes, films, disks, memory cards, memory sticks or
other recordings of the Material (and all copies thereof) in whatever form, to the
Premier League and/or the Club and the copyright, database right and all other
rights, title and interest in and to all Material is hereby assigned to the Premier
League, including by way of present assignment of future copyright pursuant to
section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if
and whenever required to do so by the Premier League) to promptly execute all
instruments and do all things necessary to vest the right, title and interest in such
rights to the Premier League absolutely and with full title guarantee.
2.5 Mobile telephones and other mobile devices are permitted within the Ground,
PROVIDED THAT (a) they are used for personal and private use only (which, for
the avoidance of doubt and by way of example only, shall not include the
capturing, logging, recording, transmitting, playing, issuing, showing, or any other
communication of any Material for any commercial purposes); and (b) no Material
that is captured by a mobile telephone or other mobile device may be published or
otherwise made available to any third parties including, without limitation, via
social networking sites.
2.6 Save for official Club merchandise and/or other football-related clothing worn in
good faith, you shall not bring into, use, wear, or display within the Ground any
sponsorship, promotional or marketing materials.
2.7 You shall not offer or distribute (either free or for sale by any person) within the
Ground any consumer article or commercial product of any nature. For the
avoidance of doubt this clause shall not prevent the lawful distribution of text
publications in any format which do not infringe clause 2.6 above where both the
content and the publication are lawful in all respects and do not in the Club’s
reasonable opinion constitute a threat to public order.
2.8 The Club reserves the right to refuse admission to, or eject from, the Ground any
person who fails to comply with the Terms & Conditions of Entry.
2.9 Without prejudice to the representation at clause 1.2 above, and in light of the
Season Ticket holders being grouped together in designated areas, any attempt to
gain access to the Ground wearing or carrying apparel (including, without
limitation, hats and/or scarves) that demonstrate support for the Away Club, may
result in admission being refused or you being ejected from the Ground and in
such circumstances no refund or alternative seat will be offered.
2.10 Concessionary Season Tickets are categorised by the Club as “-8”, “-18”, “Junior
Combo”, “Family”, “Young Adult”, “Student”, “Armed Forces” and “Over 65”
(“Concessions”) and the price payable in respect of that Season Ticket will vary
accordingly. Subject to clause 2.11 below, you are eligible to hold:-
a. an “-8” concessionary Season Ticket if you are under the age of 8 on 1
b. an “-18” concessionary Season Ticket if you are 8 years of age or more but
under the age of 18 on 1 September 2015;
c. a “Junior Combo” concessionary Season Ticket if you are adult,
accompanied by a child who is under the age of 18 (on 1 September 2015);
d. a “Family” concessionary Season Tickets if your party comprises 2 adults and
2 children who are under 16 (on 1 September 2015) or 2 adults and 2 children
who are under 8 (on 1 September 2015);
e. a “Young Adult” concessionary Season Ticket if you are 18 years or older but
under the age of 21 on 1 September 2015;
f. a “Student” concessionary Season Ticket if you are over the age of 21 and in
full-time education on 1 September 2015 (in which case you must either (i)
complete a student form and have it endorsed by your college/university or (ii)
produce proof of enrolment which includes a photo);
g. an “Armed Forces” concessionary Season Ticket if you are a full-time active
member of HM Forces (in which case an armed forces ID card or a certificate
of employment must be produced); and
h. an “Over 65” concessionary Season Ticket if you are over the age of 65 on 1
2.11 Concessions are not available to purchase in certain areas of Villa Park. If you do
purchase a Concession, but are not eligible to use that Concession at a particular
Match, the Club reserves the right to require you and your party to move to
another area of the Ground. By way of example only, if you hold a Family
Concession but are not accompanied by a child or children at a particular Match,
the Club reserves the right to require you to move from the Family area of the
Ground. Whilst the Club will use reasonable endeavours to move you (and your
party) to an area of the Ground which is of equal or lesser cost, in circumstances
where the area which you are moved to is more expensive than the area in which
your Concession is located, the Club reserves the right to charge you the balance.
2.12 Proof of age or status to validate a Concession must be available for inspection by
the Club at all times. The Club reserves the right to remove or refuse admission to
anyone (including members of their party) who is unable to evidence their right to
receive a Concession.
3. Use of Season Ticket
3.1 Subject to clause 3.2, below, Season Tickets are issued for your sole use and you
shall not sell, dispose of, assign, transfer, lend or otherwise deal with the Season
Ticket or the benefit of it to any other person without the prior written consent of
the Club. Further you shall not use the Season Ticket for any commercial purpose.
The reference to selling the Season Ticket includes: (a) offering to sell a Season
Ticket (including, without limitation, via any website or online auction site); (b)
exposing a Season Ticket for sale; (c) making a Season Ticket available for sale
by another person; (d) advertising that a Season Ticket is available for purchase,
which for the avoidance of doubt (and by way of example only) means that this
Season Ticket may not be offered as a prize in any promotion or competition; (e)
transferring, lending or selling a Season Ticket to any third party as part of a
hospitality or travel package; and (f) giving (or offering to give) a Season Ticket to
a person who pays or agrees to pay for some other goods or services (or offers to
do so); all save as expressly authorised by the Premier League or the Club.
3.2 You may only sell or transfer the Season Ticket:
3.2.1 to a Guest with the express written consent of the Club given at the
Club’s absolute discretion, provided that such sale or transfer is in
respect of an individual Match and in consideration of no payment or
benefit in excess of the face value of a ticket to that Match and provided
further that such transfer does not take place during the course of any
business or for the purpose of facilitating any third party’s business;
3.2.2 to any person without the express written consent of the Club, provided
that such sale or transfer is in respect of an individual Match and is made
via (and in accordance with the terms and conditions of) the Official
Ticket Exchange only,
each such resale or transfer is hereby provided to be subject to the Terms and
Conditions of Entry which will (save for any rights to transfer under this clause)
apply to and bind the recipient of the Season Ticket as if he/she was the original
purchaser of the Season Ticket (and where the Season ticket is sold or transferred
to a Guest pursuant to clause 3.2.1 you must inform them of this).
3.3 The unauthorised sale or disposal of a Season Ticket may amount to a criminal
offence under section 166 of the Criminal Justice and Public Order Act 1994, as
amended by the Violent Crime Reduction Act 2006. The Club will inform the
police when it becomes aware that a Season Ticket has been sold or disposed of
illegally and will press for charges to be brought against those breaking this law.
If you are convicted of a ticket touting offence, or we reasonably suspect you have
committed such an offence, we will notify the Premier League who may in turn
notify other football clubs, event holders and/or the relevant law enforcement
authorities. The information that we share may include your personal details,
information about the offence and about ticket purchases (including payment
details). We will use this to identify and prevent ticket touting offences and
disorder at matches.
3.4 The Season Ticket will remain the property of the Club at all times and must be
produced together with evidence of your identity if required to do so by any official,
steward or employee of the Club or any police officer. The Club reserves the right
to require the immediate return of the Season Ticket at any time.
3.5 The Club reserves the right to suspend the use of a Season Ticket and all
associated benefits for a period of time, withdraw its use and such benefits
completely and/or terminate its contract with you for the purchase of the Season
Ticket if (i) you (or any person using your Season Ticket) breaches any of these
terms and conditions or otherwise misuses the Season Ticket or (ii) you (or any
person using your Season Ticket) breaches any terms and conditions applicable
to a match in which the Club plays or (iii) you are prohibited from attending any
football ground (including Villa Park). Save as expressly set out in these terms
and conditions, the Club shall not be obliged to make any refund to you if your
Season Ticket and associated benefits are suspended or withdrawn or if your
contract for the purchase of a Season Ticket is terminated.
3.6 Any Season Ticket obtained or used in breach of the Terms & Conditions of Entry
shall be automatically void and all rights conferred or evidenced by such Season
Ticket shall be nullified. Any person seeking to use a Season Ticket in breach of
the Terms and Conditions of Entry in order to gain entry to the Ground or remain
at a Match will be considered to be a trespasser and will be refused entry to, or
ejected from, the Ground in respect of a particular Match and/or may have his/her
Season Ticket cancelled or withdrawn. In the event of any cancellation and
withdrawal in accordance with this clause 3.5, no refund shall be payable to the
holder in respect of any unexpired portion of the Season Ticket. The Club further
reserves its right to take any legal or disciplinary action against any person(s) as it
sees fit in connection with such matters, including a claim for an account of any
profits made from an unauthorised use of the Season Ticket.
4. Changes to Dates, Refunds & Exchanges
4.1 No guarantees can be given by the Club that a Match will take place at a particular
time or on a particular date. The Club reserves the right to reschedule any Match
without notice and without any liability whatsoever. Your Season Ticket will enable
you to attend the re-arranged Match.
4.2 The Club will have no further liability whatsoever, including (but not limited to) any
indirect or consequential loss or damage, loss of enjoyment or
5. Lost or Stolen Season Tickets
5.1 In order to gain admission to the Ground, the Season Ticket must be presented in
its entirety at every Match.
5.2 In the event that you forget your Season Ticket in respect of any individual Match,
the Club shall not be obliged to admit you or issue any other form of ticket for that
Match. If a match-day duplicate ticket is issued, the Club may require payment of
a non-refundable administration charge.
5.3 If, in the Club’s opinion, a Season Ticket is damaged, lost, stolen or destroyed, a
duplicate Season Ticket shall be issued by the Club as soon as reasonably
practicable after the payment of a non-refundable administration charge. In
making its decision, the Club shall be entitled to call for all reasonable evidence of
the need for a replacement Season Ticket, for example but not limited to a police
crime reference number in the event that a Season Ticket is stolen, or a copy of
the damaged Season Ticket. Only one duplicate Season Ticket will be issued to
you per season and you will be required to sign a document confirming that the
original Season Ticket is damaged, lost, stolen or destroyed and indemnifying the
Club against any direct or indirect consequences of such matter having been
falsely represented or stated to the Club.
5.4 Should any Season Ticket when applied for not arrive in the post after purchase,
you will be required to sign a document confirming this and undertaking to
immediately return the original Season Ticket to the Club should it come into your
possession at any time. There will be no charge for the issue of a duplicate
Season Ticket in this instance.
6. Change of Address
If you change your address during the season you must notify the Club as soon as
reasonably practicable by email to firstname.lastname@example.org.
7. Cancellation & Withdrawal of Season Ticket
7.1 Without prejudice to any other remedies it may have, the Club shall have the right
in the case of any serious or persistent breach of the Terms & Conditions of Entry
to cancel and withdraw your Season Ticket. In the event of such cancellation no
refund will be paid in respect of any unexpired portion of the Season Ticket.
Without prejudice to the general nature of the above the following actions shall
constitute serious breach of the Terms & Conditions of Entry:
7.1.1 smoking in designated non-smoking areas;
7.1.2 being (or appearing to be) intoxicated;
7.1.3 persistent standing in seated areas whilst the Match is in progress;
7.1.4 the sale or transfer (save as permitted) of a Season Ticket to any
7.1.5 the possession of a banner or flag that bears material or slogans that
are offensive, obscene, abusive or racist;
7.1.6 the deliberate misuse of a Season Ticket;
7.1.7 the supply of any misleading or incorrect information in any
7.1.8 the throwing of any object within the Ground that may cause injury,
damage, distress or annoyance to people or property without lawful
authority or excuse;
7.1.9 whether at the Ground, or, travelling to or from a Match:
220.127.116.11 the use of foul, obscene, abusive and/or racist language
18.104.22.168 the chanting of anything of an indecent or racist nature;
22.214.171.124 fighting or engaging in and/or inciting violence;
7.1.10 bringing into the Ground (or using within the Ground): illegal drugs,
other illegal substances, fireworks, firecrackers, smoke canisters, air
horns, flares, laser devices, bottles, glass vessels or any item that
might be used as a weapon or compromise public safety;
7.1.11 entering the playing area or any adjacent area to which spectators are
not generally admitted without lawful authority or excuse;
7.1.12 any misrepresentation in relation to clause 1.2 above;
7.1.13 breach of the terms of any Membership;
7.1.14 any breach of clauses 2.4, 2.5 or 2.6 above; and
7.1.15 any failure to pay or default of payment in respect of any sums owing
to the Club (or any third party) in respect of any Season Ticket.
7.2 The Club may conduct security searches where it has reason to believe that any of
the breaches set down in 7.1 has either occurred or may occur.
7.3 If a Season Ticket holder is not 16 years old or over, his/her parent(s) and/or
guardian(s) are responsible for his/her actions, conduct and compliance with the
Terms and Conditions of Entry.
7.4 In the event that your Season Ticket is withdrawn or cancelled the Club reserves
the right to exclude you from any membership scheme maintained or organised by
the Club and/or to disqualify you from applying for any Match ticket or season ticket
at its discretion, and to notify any Football Authority and/or other football clubs of
such exclusion and/or disqualification (and the reason(s) for such exclusion and/or
8. Filming, photography and taping
All Season Ticket holders who enter the Ground acknowledge that photographic images
and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom)
may be taken of them and may also be used, by way of example and without limitation, in
televised coverage of the game and/or for promotional, training, editorial or marketing
purposes by the Club, the Premier League, or others (including commercial partners and
accredited media organisations), and use of a Season Ticket to enter the Ground constitutes
consent to such use.
9. Exclusion of Liability
9.1 The Club hereby excludes any liability for loss, injury or damage to persons/property
in or around the Ground except in respect of death or personal injury resulting from
any negligence of the Club or any other liability of the Club which cannot be
excluded under applicable law.
9.2 Neither the Premier League nor the Club shall be responsible for any interruptions
and/or restrictions to the view of the Match caused by virtue of (a) the position of the
seat and/or (b) the actions of other spectators.
9.3 The Club hereby excludes any liability for any loss, injury, costs, expenses or
damage of any kind connected to your use of the Official Ticket Exchange,
including, without limitation, any liability relating to any problem with, suspension of
or termination of the Official Ticket Exchange, in each case except in respect of
death or personal injury resulting from any negligence of the Club or any other
liability of the Club which cannot be excluded under applicable law.
10.1 The Club reserves the right to change these Conditions of Issue from time to time,
and shall notify you of such changes if they materially affect your rights as a
10.2 You consent to the Club holding and processing data relating to you for
administrative and legal purposes. The personal data that you provide to the Club
shall be processed, stored and transferred in accordance with the terms of the
10.3 The invalidity or partial invalidity of any provision of these Conditions of Issue shall
not prejudice or affect the remainder of these Conditions of Issue, which shall
continue in full force and effect. If any invalid, unenforceable or illegal provision of
this agreement would be valid, enforceable and legal if some part of it were deleted,
the provision shall apply with the minimum modification necessary to make it legal,
valid and enforceable.
10.4 The Club’s failure to exercise, or delay in exercising, any right, power or remedy
provided by these Conditions of Issue or by law shall not constitute a waiver of that
right, power or remedy.
10.5 The Terms and Conditions of Entry constitute the entire agreement between the
Club and the Season Ticket holder and neither the Club nor the Season Ticket
holder shall have any claim or remedy in respect of any statement, representation,
warranty or undertaking made by or on behalf of any other party in relation to the
Terms and Conditions of Entry which is not set out therein.
10.6 Notwithstanding any other provision in these Conditions of Issue and with the
exception of any Football Authority, no other person other than you or the Club has
any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or
enforce any term of these Conditions of Issue. Nothing in these terms of conditions
shall affect any right or remedy of a third party that exists or is available other than
as a result of the aforementioned Act.
10.7 These Conditions of Issue shall be governed by and construed in accordance with
the laws of England and Wales. The parties hereby submit to the exclusive
jurisdiction of the Courts of England and Wales (including in relation to any noncontractual
disputes or claims).
In the Conditions of Issue the following words and phrases shall have the following meanings:
“Away Club” means the football club playing against the Club.
"Conditions of Issue" means these terms and conditions governing the issue and use of a
“Football Authority” means each of the Premier League, The Football League, The Football
Association, The Football Association of Wales, FIFA, UEFA and other relevant governing
body of association football.
"Ground" means the football stadium and all other locations owned, occupied or utilised by
"Ground Regulations" means those ground regulations issued by the Club from time to time
that set out the terms and conditions upon which spectators are granted entry to the Ground.
"Guest" means a relative, friend, colleague and/or companion to the disabled who would be
entitled to purchase a Season Ticket under the Terms & Conditions of Entry.
"Match" means any Premier League football match in which the Club participates and that
takes place at the Ground during Season 2015-2016.
“Material” means any audio, visual or audio-visual material or any information or data.
“Membership” means any rules and regulations agreed in relation to your participation in the
Club’s membership schemes or packages.
"Official Ticket Exchange" means the Club's authorised ticket resale facility which as at the
date hereof is Seatwave (www.seatwave.co.uk).
"Season Ticket" means a season ticket booklet (and all or any component vouchers therein)
or any season ticket smartcard (and/or any rights arising out of or in connection with any of
the foregoing) for admission to Matches.
"Terms & Conditions of Entry" means each of the rules and regulations of any Football
Authority; the Ground Regulations; and the Conditions of Issue.
12. Use of Match Ticket
12.1 Tickets are issued for your sole use and you shall not resell, assign or (save as set out in clause 3.2 below) transfer or lend the ticket or the benefit of it to any other person without the prior written consent of the Club. For the avoidance of doubt (and by way of example only) tickets may not be offered as a prize in any promotion or competition nor transferred, lent or sold to any third party as part of a hospitality or travel package, save as expressly authorised by the FA Premier League Limited or the Club.
12.2 You may only resell or transfer the ticket with the express written consent of the Club given at the Clubs absolute discretion. No such resale or transfer will be permitted except where the same takes place in consideration of no payment or benefit in excess of the face value of a ticket to that match and such lending does not take place during the course of any business. Upgrades from a Concession rate to Adult can only be carried out through the Clubs ticket office.
12.3 The unauthorised sale of tickets may be illegal under section 166 of the Criminal Justice and Public Order Act 1994.
12.4 The ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to retain the ticket at any time.
12.5 Any ticket obtained or used in breach of the Terms & Conditions of Entry shall be void and all rights conferred or evidenced by such ticket shall be nullified. Misuse of this ticket may result in the holder being ejected from the Ground. In the event of any cancellation or withdrawal no refund shall be payable to the holder. The Club further reserves its right to take any legal action against any appropriate persons as it sees fit in connection with such matters.
13. Changes to Dates, Refunds & Exchanges
13.1 No guarantees can be given by the Club that a match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any match without notice and without any liability whatsoever. Your ticket will enable you to attend the re-arranged match.
13.2 The Club will have no further liability whatsoever, including (but not limited to) any direct or consequential loss or damage, loss of enjoyment or travel costs.
13.3 Refunds will be considered for home match tickets up to 24 hours prior to kick off, after this time no refunds will be available. For away matches refunds will only be considered until 8 days before the match.
14. Cancellation & Withdrawal of Match Tickets
14.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of these Terms & Conditions of Entry to cancel and withdraw your ticket. In the event of such cancellation no refund will be paid. Without prejudice to the general nature of the above, the following actions shall constitute serious breach of the Terms & Conditions of Entry:
14.1.1 smoking in designated non-smoking areas;
14.1.2 persistent standing in seated areas whilst the match is in progress;
14.1.3 sale or transfer (save as permitted) of this ticket to any person;
14.1.4 deliberate misuse of the ticket;
14.1.5 the supply of any misleading or incorrect information in any application;
14.1.6 persistent swearing during the match;
14.1.7 the throwing of any object within the Ground without lawful authority or excuse;
14.1.8 the chanting of anything of an indecent or racist nature;
14.1.9 any misrepresentation in relation to clause 1.1;
14.1.10 breach of the terms of any membership;
14.1.11 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of this ticket.
14.2 In the event that your ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any match ticket or season ticket at its discretion.
15. Exclusion of Liability
15.1 To the maximum extent permitted by law, the Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground.
16. Governing Law
16.1 These Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.
In the Conditions of Issue the following words and phrases shall have the following meanings:
"Conditions of Issue" means these terms and conditions governing the issue and use of a Match Ticket.
"Ground" means the football stadium and all other locations owned, occupied or utilised by the Club.
"Ground Regulations" means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground (copies of which are available upon request).
"Match" means any FA Premier League football match in which the Club participates and that takes place at the Ground.
"Terms & Conditions of Entry" means each of the rules and regulations of FIFA, UEFA, The Football Association, The Football Association Premier League Limited (FAPL) and The Football League; the Ground Regulations; and the Conditions of Issue.
Single Match Hospitality Booking Terms and Conditions
These Terms set out the Terms upon which Aston Villa Football Club Limited (“the Club”) will provide the Hospitality to you. Your payment for Club Hospitality signifies your acceptance of these Terms and your agreement to comply strictly with them.
1.1 “Hospitality” means the sponsorship and/or hospitality package that you wish to purchase from the Club.
1.2 “Stadium” means Villa Park, Birmingham, B6 6HE.
1.3 “you” means the person or legal entity whose is purchasing a sponsorship and/or hospitality package from the Club.
2.1 Your Hospitality booking will be deemed accepted by the Club upon receipt by the Club of the payment for your Hospitality.
BY PAYING YOU ARE MAKING A CONFIRMED BOOKING WHICH CREATES A BINDING CONTRACT BY WHICH YOU AGREE TO PURCHASE AND THE CLUB AGREES TO SUPPLY THE HOSPITALITY ON THESE TERMS. ONCE A BOOKING HAS BEEN PAID FOR YOU MAY ONLY CANCEL IT OR REARRANGE IT IN ACCORDANCE WITH CLAUSE 9.
3. PAYMENT TERMS
3.1 Payment of the Fees for the Hospitality is required in full at the time of booking by Credit or Debit Card.
3.2 The Club reserves the right to cancel the Hospitality (without liability) and apply the cancellation charges set out in Clause 9 in the event that payment is not received in accordance with this clause.
3.3 Tickets for the Hospitality will not be released until the Club is in receipt of full payment or cleared funds in payment of the Hospitality.
3.4 In the case of Club Hospitality season ticket holders who wish to purchase extra Hospitality for matches or purchase extra Club benefits on an ad hoc basis the following terms will apply:-
3.4.1 The Club will send you an invoice for the Hospitality (plus VAT). Invoices must be paid in full:-.
3.4.1 within 30 days of the date of the invoice in circumstances where the Hospitality is to be provided more than 30 days after the date of that invoice; or
3.4.2 within 7 days of the date of the invoice in circumstances where the Hospitality is to be provided more than 7 days, but less than 30 days, after the date of that invoice; or
3.4.3 at the time of booking the Hospitality, in circumstances where the Hospitality is to be provided 7 or less days from the date of the invoice (in which circumstances payment shall be made by debit card, credit card, cash or cleared funds BACS transfer, but NOT by cheque);
3.4.4 failure to pay the invoices in full within the time periods stipulated in this clause 3.4 will result in the cancellation of the booking by the Club. In these circumstances the Club reserves the right to apply the cancellation charges as are set out in clause 9.1.
3.5 The Club reserves the right at any time to review your credit account facilities with the Club and the Club reserves the right at any time to suspend or cancel the provision of Hospitality to you should you be in arrears with any payments due to the Club.
4.1 Parties of less than 10 cannot be guaranteed a private table.
4.2 You must inform the Club of any special dietary requirements of you or your guests at least 10 days prior to the date of the Hospitality in accordance with clause 11.1. We will use reasonable endeavours to meet reasonable requests made on the day of the Hospitality, but we are unable to guarantee this.
4.3 You must inform the Club of any away-team supporters who are among your guests for the Hospitality. Away-team supporters may (at the Club’s sole discretion) be seated in away-team supporter seating at the Stadium. Where this occurs, half-time refreshments which form part of the Hospitality (if any) will be served at full-time to you and your guests.
4.4 It is your responsibility to ensure that any away-team supporters that sit within home-team supporter areas of the Stadium are made fully aware that they are seated with home-team supporters and that appropriate conduct is required of them. The Club reserves the right (without liability) to eject anyone from the Stadium whom it considers (in its sole discretion) is acting in a threatening, abusive or inappropriate manner or whose presence or behaviour may (in the Club’s opinion) create and/or increase potential crowd disorder at the Stadium..
4.5 You shall and shall procure that your guests observe any rules and regulations that the Club makes and notifies to you from time to time, and you will, when enjoying the Hospitality, observe all reasonable verbal instructions from members of the Club’s staff.
4.6 The Club reserves the right to cancel the Hospitality on notification that your guests include away supporters without liability except for a refund of the Fees paid. The Club further reserves the right to refuse the admittance of away supporters to the Hospitality areas in its absolute discretion and if the Club was not notified in advance that away supporters were included in your party no refund will be paid by the Club in respect of any unused Hospitality.
4.6 The Club reserves the right to suspend the Hospitality and all associated benefits (and/or any other hospitality in your name) for a period of time, to withdraw its use and/or terminate the contract between you and the Club in the event that you or any of your guests breaches any of these Terms, harasses, threatens, breaches the privacy of or otherwise behaves inappropriately (in the Club’s opinion) to any member of Club staff or any other person or otherwise misuses the Hospitality. In addition, the Club reserves the right (without liability) to refuse access to the Hospitality to anyone whose behaviour (whether current or past) in the reasonable opinion of the Club is not of the standard expected for persons attending the Club’s Hospitality suites. In the event that the Club suspends or withdraws the Hospitality no refund will be paid in respect of any unused Hospitality.
5. DRESS CODE
5.1 A smart casual dress code must be followed by all persons enjoying the Hospitality. Trainers, tracksuits, replica football shirts (including home team kit) and away team colours are strictly not permitted. Subject to clause 5.3 below, denims are permitted but must be smart in appearance, with no rips, tears or bleaching. Specific dress codes may be imposed by the Club for any particular Hospitality area or match and it is your responsibility to check with the Club for any particular requirements.
5.2 Children under the age of 16 are permitted to wear football colours/replica kit for the Club teams only.
5.3 In circumstances where the Hospitality comprises entrance to the Directors area of the Stadium, you and your guests must wear a jacket (which has a collar), shoes and trousers; however a tie is not essential.
5.4 It is your responsibility to inform your guests of the relevant dress codes.
5.5 The Club reserves the right (without liability) to refuse access to the Hospitality to anyone who does not follow the relevant dress code.
6. CAR PARKING
6.1 In circumstances where the Hospitality includes car parking, the Club will inform you in advance of such Hospitality where you and your guests may park. Car parking may be provided (at the Club’s sole option) within the Stadium’s car parks or within an offsite car parking facility, which may not be owned by the Club.
6.2 All car parks and roads adjacent to the Stadium have access restrictions on matchdays, which the Club will inform you of in advance. If such access restrictions are not observed, you may be unable to access the car parking assigned to you and your guests for which the Club accepts no liability.
6.3 Under no circumstances are Hospitality car park permits to be passed on, loaned or sold.
7. PHOTOGRAPHY AND CCTV
7.1 Photographers will be present during the Hospitality and some crowd photographs may be taken and used by the Club for media and marketing purposes. By making the booking you hereby consent to your image being used in this way. You further undertake to obtain the consent of your guests to such use. If you have any concerns or would like to discuss this further, please contact the Club’s Marketing Department.
7.2 CCTV is employed and operated within the Stadium for the control and safety of spectators.
8. RE-SCHEDULED MATCHES
8.1 In the event that the match at which you are receiving the Hospitality is rescheduled by the Club for any reason, the Hospitality shall be provided at the rescheduled match without liability to the Club.
9.1 Subject to clause 9.1, in the event that you cancel the Hospitality, the Club reserves the right to apply the following charges:-
90-61 days prior to the Hospitality – 25% of total charge
60-31 days prior to the Hospitality – 50% of total charge
30-7 days prior to the Hospitality – 75% of total charge
Less than 7 days prior to the Hospitality – 100% of total charge.
9.2 In the event that you seek to rearrange the Hospitality to a different match, the Club will use reasonable endeavours to accommodate you. In the event that the Club is unable to do so, the Hospitality will be cancelled and the cancellation charge relevant to the date of your request will apply.
9.3 We shall be entitled to terminate this Contract by written notice to you at any time before 7 days prior to the start of the Hospitality. In the event that we exercise this right, we shall refund to you all Fees that we have received from you in connection with the Hospitality.
10.1 The Club accepts no liability for Hospitality applications, tickets, permits or passes which are lost in the post, mislaid or destroyed. Duplicate tickets, permits and/or passes may (at the Club’s sole discretion) be supplied, upon receipt of a written explanation of the circumstances surrounding the loss and/or damage. The Club reserves the right to charge an administration fee to produce replacements.
10.2 The Club does not accept liability for any of your articles or possessions left in or at the Stadium.
10.3 The Club reserves the right to charge you for the cost of any repairs, cleaning, maintenance and/or replacement of any property or facilities at the Stadium resulting from any act or omission of you or a guest.
10.4 The Club shall:-
10.4.1 be liable for death or injury caused by its negligence;
10.4.2 be liable for damage to, or loss of, any of your goods or property or that of your guests which are brought into the Stadium and which is caused by the Club’s negligence up to a maximum liability of £1,000 in respect of any single event or series of connected events;
10.4.3 not be liable for any other losses, claims, demands, actions, proceedings, damages, costs, expenses or other liabilities which you or any of your guests may incur or suffer otherwise than in accordance with Clauses 10.4.1 and 10.4.2.
11. CATERING SERVICES AND FACILITIES
11.1 The Club shall use our reasonable skill and care in the provision of the services and shall execute our obligations in providing the Hospitality in a proper, diligent an efficient manner. In particular, we shall take all necessary precautions and act with all due diligence in the preparation and processing of all food to be consumed at the match in order to prevent and avoid any breach of the Food Safety Act 1990 and all regulations, orders or codes of practice enacted under the Act and all other legislation, regulations and codes of practice relating to the supply of food and drink. It is your responsibility to return to us the Special Diets and Allergen Information Form at least 10 days prior to your fixture or within 24 hours of booking if this is within 10 days of the fixture.
12. MATCH SPONSORSHIP
12.1 The Club shall be entitled to cancel a booking for a sponsorship with immediate effect, without liability except for a full refund to you of all monies paid to the Club, if in the Club’s opinion your proposed sponsorship conflicts in any way with either one of the Club’s sponsors or a sponsor of the football governing body of the relevant match.
13.1 Entry to the Stadium is expressly subject to acceptance by you and your guests of the Stadium’s ground regulations and the rules and regulations of FIFA, UEFA, The Football Association, The FA Premier League and The Football League in the respect of the relevant competition.
13.2 These Terms shall be governed by and construed in accordance with the laws of England and shall be subject to the exclusive jurisdiction of the English Court.
13.3 Save as specifically provided herein, a person who is not a party to these Terms shall have no rights under or in connection with them.
